Pros Associated with Short-term Rentals | Air B&B
- Increases the number of available rental units to meet the flexible demand
- Provides a greater diversity of available types and locations of rental units
- Provides a revenue stream for homeowners (investment opportunities, renovations, etc)
- Provides additional marketing for the community
Cons & Challenges for Community
- Increased demand for Village services and resources
- Short-term rental typically brings greater noise, greater congestion for parking, increased water & septic usage and generates greater garbage than residential use
- If unregulated, allows for tax evasion
- Safety concerns for consumers if uninspected by qualified safety inspector
For the above-mentioned reasons, the Village Board will require a permit for short-term residential rentals. The following are proposed details of the permitting of short-term residential rentals.
Permit Application Requirements (In addition to long-term residential rental code requirements):
- Applicant must be an “actual person” with an ownership interest in the subject real property
- Inspections will be performed annually by the designated Village Code Enforcement Officer
- Subject property must have a valid CO
- Subject property shall be clear of any outstanding code violations
- Subject property must be insured with liability limits of not less than 1 million / 2 million aggregate
- The septic system at Subject property must meet current code
- Septic at Subject property must have been pumped and inspected within 12 months preceding the application
- Septic must be pumped within 12 months preceding each year’s renewal.
- Permit for short-term residential rental must be renewed every 12 months
- Subject property will be required to maintain working illuminated exit signs above at least the main entrance and the main exit of the Subject property
- Parking spaces will be designated by the building inspector on a case by case basis
- Garbage will not be permitted curbside until 5pm the preceding night prior to scheduled refuse pickup
- Permits area privilege and not an entitlement and subject to review and suspension by the Village Board
Fees (Adopted Mar 21,2022 Resolution #40)
- Initial registration and inspection fee for owner/agent occupied fee: $250
- Renewal registration and inspection fee for owner/agent occupied fee: $100
- Initial registration and inspection fee for other-than-owner/agent occupied fee: $1,000
- Renewal registration and inspection fee for other-than-owner/agent occupied fee: $750
Fines
- Operating without a short term residential rental permit, a fine of up to $1,000 per day.
- Failure to have any required inspection up to $250 per day.
Timeline:
- Mailing to notify all residents of the new law shall be complete by January 1
- Approved permits will be required for the June 1, 2018 – May 31, 2019 year and must be approved no later than May 31, 2018 to operate after June 1, 2018
- Applicant should allow up to 30 days for processing.
